These Terms of Service (“Terms”) are a legally binding agreement between you (“User,” “you,” or “your”) and CrazyEngineers Technologies Private Limited (“Company,” “we,” “us,” or “our”). These Terms govern your access to and use of the Jatra platform (“Service” or “Platform”), including any websites, apps, and related services we provide. If you do not agree to these Terms, do not access or use the Service.

Definitions

  • “Service” or “Platform” refers to Jatra, an online community-building platform operated by the Company.
  • “User,” “you,” or “your” refers to anyone who accesses or uses the Service, including community creators, members, moderators, and visitors.
  • “Community Creator” refers to a User who creates, owns, or manages a community on the Service.
  • “Content” includes text, images, videos, audio, links, files, and any other materials submitted, posted, or displayed through the Service.
  • “Account” means the credentials and profile created by a User to access the Service.
  • “Subscription Plan” means any free or paid plan offered by the Company for using the Service.

1. About Jatra and our role

Jatra is a platform designed to help users create, customize, and manage branded online communities. The Company provides the tools and infrastructure to host communities, but does not participate in, control, or endorse user-run communities.

Platform provider, not a party: The Company is not a publisher of user Content and is not responsible for Content posted by Users or Community Creators. Any opinions, advice, statements, services, offers, or other information expressed or made available by Users are those of the respective Users.

2. Eligibility

You must be at least 13 years old to use the Service. If local law requires a higher minimum age, you must meet that requirement. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian.

3. Accounts

  • Account creation: You must provide accurate and complete information to create an account. You may sign up using email or supported social login options.
  • Account security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account.
  • Multiple accounts: You may create multiple accounts provided each account is tied to a unique email address.
  • Cancellation: You may cancel your subscription or delete your account at any time, subject to billing terms and any applicable legal or compliance requirements.
  • Suspension or termination: We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if we reasonably believe your actions could harm the Service, other users, or our reputation.

4. Subscriptions, billing, and refunds

  • Plans: Subscription Plans and pricing are described on our Pricing page. We may update plans and pricing over time.
  • Billing: Paid plans are billed in advance on a monthly or annual basis (as selected). Taxes may apply depending on your location.
  • Trials: If a free trial is offered, it may convert into a paid subscription unless canceled before the trial ends.
  • Payments: Payments may be processed by third-party processors. We do not store your full payment card details on our servers.
  • Refunds: Refunds, if any, are governed by our Refund & Cancellation Policy.

5. Acceptable use

You agree not to misuse the Service. This includes, but is not limited to:

  • Posting illegal content or engaging in illegal activities.
  • Harassment, hate speech, threats, or discriminatory content.
  • Spam, scams, phishing, or deceptive practices.
  • Uploading malware or attempting to disrupt or overload the Service.
  • Unauthorized scraping, crawling, or automated access that harms the Service.
  • Attempting to access accounts, data, or systems you do not have permission to access.
  • Reselling, sublicensing, or white-labeling the Service without written permission.

6. User content and community responsibilities

6.1 Content ownership

You retain ownership of the Content you submit, post, or display through the Service.

6.2 License to operate the Service

To provide and operate the Service, you grant the Company a non-exclusive, worldwide, royalty-free, transferable license to host, store, cache, reproduce, display, and distribute your Content solely as necessary to operate, improve, and make the Service available (for example, to display your Content to members of your community and to enable search, indexing, and content delivery features).

6.3 Marketing use

We may use anonymized or aggregated information (for example, community counts, usage patterns, or non-identifiable excerpts) to market the Service. If we want to use identifiable Content (such as your name, community name, logo, or screenshots of private areas) for marketing, we will seek your permission unless permitted by law.

6.4 Moderation and community creator responsibility

Community Creators are solely responsible for their communities, including rules, moderation, member management, and handling disputes. We may (but are not obligated to) review, remove, or restrict Content or communities if required by law, to enforce these Terms, or to protect the Service and users.

7. Privacy and security

Our Privacy Policy explains how we collect, use, and protect personal data. While we take reasonable measures to secure the Service, no system is completely secure, and we cannot guarantee absolute security.

8. Availability, changes, and support

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, upgrades, or issues outside our control.

We may modify, suspend, or discontinue parts of the Service over time. We will try to provide reasonable notice for significant changes when practical.

9. No guarantee of outcomes

The Service may help you create content and communities that can support organic growth, discovery, or engagement. However, we do not guarantee traffic, SEO rankings, revenue, lead generation, or growth outcomes. Results depend on many factors, including your content, strategy, and external platforms.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Service will not exceed the amount you paid to the Company for the Service in the three (3) months immediately preceding the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Content, or your violation of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by email or by posting a notice on the Service. Updated Terms become effective once posted, unless stated otherwise.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Maharashtra, India.
